Press Release
Arrests/Murder Investigation

Canton, Cherokee County, Ga. October 21, 2004   Investigators with the Cherokee Sheriff’s Office, Cherokee County District Attorney’s Office, and the Georgia Bureau of Investigations determined that the death of four-year-old Sebastian Nowak that occurred on September 12, 2004 was a homicide. Autopsy results show that the child was suffocated by force. Investigators also said the child had suffered eleven broken ribs for which he had not received medical attention. The child had recently been treated for a broken leg as well as a broken arm during the weeks leading up to his death; indications are that these injuries were intentional. Pursuant to the investigation, the Cherokee Sheriff’s Office arrested the child’s mother, April Nowak 26 years of age, and charged her with Child Endangerment. Nowak is currently being held in the Cherokee County Adult Detention Center with a bond set at $22,100.00. Her boyfriend, Dale Jay Richter 30 years of age, has been charged with Murder and three counts of Cruelty to Children in the 1st Degree. Richter, is currently being held at the Cobb County Adult Detention Center on unrelated charges. No bond has been set in Cherokee County for Richter.
